Today, Tuesday, September 25, at 4:30 pm the Fairfax County Board of Supervisors is going to have a hearing on a proposed ordinance that prohibits loaded long guns in vehicles on public roads, streets, or highways.

VCDL opposes this ordinance. There has been no issues with loaded long guns in vehicles in Fairfax County. Of the 14 localities that have such a ban, only 3 have had any arrests under their ordinance.

There was once case back in 2006 where an officer was shot and killed by a long gun that discharged in a wrecked car. My understanding is that it happened when the officer was attempting to remove the gun from the vehicle.

I am planning on attending the hearing. Anyone else who wishes to attend to speak or just to show support, please do so.

I would like to thank the ten members who showed up tonight at the Fairfax County Board of Supervisors meeting to support VCDL's position against an ordinance that would prohibit loaded long guns in vehicles on public roads.

I testified that based on a document provided to the Board by the Fairfax County Police Department, they should not pass the ban.

The police said two reasons to pass the ban were:

* a demonstration of interest in firearms regulation

* an opportunity to educate residents about firearms safety

I pointed out that neither of those reasons justifies making a new law.

The police had two reasons not to pass the ban, both of which I agreed with:

* no evidence of problems in Fairfax County related to the transportation of loaded shotguns and rifles

* requires officers to manipulate the firearm to determine if the gun is loaded, which could compromise officer safety. I added that it could end up in a situation where an officer inadvertently shoots the guns owner because of a mistake when manipulating the gun

One of our members who is a law-enforcement officer told the Board that officers are not trained on any guns but the ones they carry. So they might not know how to safely handle all the different long guns out there. The Fairfax County PD representative said the officers would be given training on a wide variety of guns if the ordinance passes. Oh, boy - that's going to be a time consuming and expensive proposition, if they do it right. Your tax dollars at work...

For a minute it looked like the proposed ordinance was going to be improved when supervisor Cook proposed an amendment to exempt those carrying long guns for their safety. Supervisor Herrity seconded it. However, the Board voted the amendment down.

Tyranny won out and the final ordinance passed UNANIMOUSLY. It will become effective on January 1, 2019.

NOTE: simply having a long gun in your vehicle does NOT give the police the probable cause to see if it is loaded or not. But that's not a guarantee that they won't do so anyhow.

VCDL is going to address the enabling law for this ordinance at the next General Assembly session, with the intent of making some improvements.

I have received quite a few emails with questions and thoughts on the Fairfax County loaded long gun in vehicles prohibition, so here is some more information on the concept in general.


IS IT LEGAL - WHAT ABOUT PREEMPTION?

The new ordinance is legal. Virginia's firearms preemption law (15.2-915) allows localities to pass certain gun ordinances IF there is a state law that specifically grants authority to do so. There aren't many such enabling laws - most of those deal with hunting or shooting. The enabling law for the ordinance in question is 15.2-915.2.

WHAT IS THE DEFINITION OF "LOADED"?

"Loaded firearm, loaded rifle or loaded shotgun as used in this Chapter means a firearm, rifle or shotgun with ammunition within the action chamber, magazine or clip which is within or on the firearm, rifle or shotgun."


ARE CHP HOLDER EXEMPT?

NO. The exemptions are, "law enforcement officers or military personnel in the performance of their lawful duties, to any person who reasonably believes that a loaded rifle or shotgun is necessary for his personal safety in the course of his employment or business, or to any person transporting a malfunctioning rifle or shotgun for the purpose of having it repaired or otherwise rendered safe."

IS THERE A WORKAROUND?

An interesting option brought up by EM John Wilburn: an AR-15 or AK handgun with a Sig arm brace. As a handgun, it is not covered by this law and for those with a CHP it can be concealed.


HOW ABOUT A LEGISLATIVE FIX?

VCDL is working on some changes to this law for the next legislative session.


WHAT IS THE PENALTY?

The penalty is a $100 fine and appears from the draft voted on at the meeting to be an infraction and not a crime.
