Another massive number of gun bills are going to be heard on Thursday afternoon:


STRONGLY SUPPORT

HB 1466, Fowler, has the Circuit Court Clerk send renewal letters to those with expiring CHPs

HB 1792, Fariss, protects a person who is prohibited from possession a firearm from a "constructive possession" charge if he merely co-habitates with someone who is not so prohibited

HB 1822, LaRock, codifies the current law on carry in churches, making self-defense a "good and sufficient reason."

HB 1849, Gilbert, allows a Circuit Court Clerk to laminate or make a permit out of plastic

HB 1852, Gilbert, makes a protection order into a CHP for 45 days. It is a CHP for 90 days if the victim applies for a permanent CHP. The provides important and immediate protections for victims of violence

HB 1853, Gilbert, provides free firearms training to speed up the acquisition of a permanent concealed handgun permit for someone with a protection order

HB 2077, Wilt, removes the restriction on the right to keep and bear arms in an emergency shelter

HB 2321, Morefield, restricted ammunition definition updated for modern technology


STRONGLY OPPOSE

HB 1683, Simon, adds Roanoke to the list of cities where carry of loaded guns is prohibited and changes the definition of "loaded"

HB 1684, Simon, takes away the requirement that a person act in a reckless manner before being charged with leaving a loaded firearm where a child under 14 can have access to it. One size does not fit all and some children can be very mature and be trained in the handling of firearms where their access is in no way reckless

HB 1685, Simon, reinstates the old "One Handgun a Month" law that had done nothing to reduce gun trafficking

HB 1700, Marshall D.W., takes away the right of a person openly carrying a firearm to have a drink with dinner and adds another penalty for being intoxicated in public. A solution in search of a problem

HB 1758, Sullivan, a sweeping gun confiscation scheme based on a "probably cause" standard. Takes away a civil right without due process

HB 1773, Plum, closes a non-existent "gun show loophole." There's nothing you can do inside a gun show that you can't do outside a gun show

HB 1778, Plum, takes away someone's gun rights for a MISDEMEANOR

HB 1864, Lopez, makes the state, and not parents, arbiters of when a child is old enough to be allowed to shoot a firearm or a pneumatic gun

HB 1865, Lopez, greatly increases the amount of time that the State Police can drag their heels in completing a background check for a CHP

HB 2044, Murphy, requires the subject of a protective order to certify within 48 hours that they have turned over all his or her guns. Possession of any guns is already covered by the law

HB 2094, Price, totally guts firearms preemption laws, allow for a huge patchwork of confusing and infringing local gun laws

HB 2098, Price, makes the state, and not parents, arbiters of when a child is old enough to posses a firearm or a pneumatic gun

HB 2187, Boysko, Universal Background Check bill, will not lower crime rates, raises the cost of a firearm, and creates a gun registration system

HB 2188, Boysko, creates a scheme to coerce private firearms sellers to sell through a licensed dealer by creating a civil liability

HB 2212, Plum, Universal Background Check bill, will not lower crime rates, raises the cost of a firearm, and creates a gun registration system

HB 2266, Filler-Corn, requires that a store or restaurant that allows guns on their property, post a prominent sign so stating, or face a civil penalty.

SB 1023, Stuart, protects the privacy of CHP holders traveling in states that don't honor VA CHPs

SB 1297, Vogel, allows an active duty member of the armed forces to get a CHP if they are 18-years-old or older. Also fixes a problem with Georgia honoring Virginia CHPs

SB 1299, Vogel, makes a protection order into a CHP for 45 days. It is a CHP for 90 days if the victim applies for a permanent CHP. The provides important and immediate protections for victims of violence

SB 1300, Vogel, provides free firearms training to speed up the acquisition of a permanent concealed handgun permit for someone with a protection order

SB 1347, Reeves, creates a concealed weapon permit to allow the holder the option of carrying less-lethal weapons

SB 1422, Chase, reduces CHP fees

SB 1440, Black, Constitutional Carry, keeps CHP system, but allows those who can legally own a handgun to be able to carry it concealed without a permit. 11 states already have such a system and the number is growing

SB 1444, Chafin, restricted ammunition definition updated for modern technology


STRONGLY OPPOSE

SB 809, Favola, requires lost/stolen gun to be reported within 24 hours. This punishes the victim of a theft and not the criminal

SB 893, Howell, duplicates federal law on locks required when dealers sell guns

SB 915, Edwards, step towards Universal Background Checks, nebulous definition of who is a "merchant of firearms." Federal law covers what this bill is trying to do already

SB 1039, Howell, requires the subject of a protective order to certify within 48 hours that they have turned over all his or her guns. Possession of any guns is already covered by the law

SB 1112, Edwards, severely damages firearms preemption, allowing for patchwork of localities who can ban guns at government meetings. A solution in search of a problem

SB 1185, Dance, requires lost/stolen gun to be reported within 24 hours. This punishes the victim of a theft and not the criminal

SB 1194, Lucas, Universal Background Check bill, will not lower crime rates, raises the cost of a firearm, and creates a gun registration system

If you are in the Richmond area and can attend the Militia, Police and Public Safety (MPPS) Subcommittee #1 hearing today starting at 4 PM, please do so. I suggest you arrive around 3:30 to get a seat. The meeting is on the 8th floor of the General Assembly Building, in the West Conference room. Look for somebody with GSL stickers. Depending on which elevator bank you come up on, the hearing room will be either to your immediate right or your immediate left.

2. It was a good morning for gun owners!

Great news! HB 1582, Campbell, which allows active duty military or those with an honorable discharge, who are at least 18 years old and have completed basic training, to get a CHP has passed out of the House and is now in the Senate. This bill both protects our military and it will also open Georgia to honoring Virginia permits.

This morning the following GUN-CONTROL bills were KILLED in the House Militia, Police, and Public Safety Subcommittee #2:

HB 1778, Delegate Plum, takes away a person’s right to purchase or transport a handgun for five years for a conviction of misdemeanor assault and battery against someone because of race, religion, color, or national origin. Misdemeanors are not meant to take away someone’s civil rights, but that’s exactly what this bill does. It also makes some people’s lives more important than other people’s lives.

HB 2098, Delegate Price, a parent, grandparent, or legal guardian would have to give prior permission for a person under 18 years old to possess a firearm on the property of that parent, grandparent, or legal guardian. This is a private, family matter, not a matter for the Commonwealth to turn into a crime.

HB 2266, Delegate Filler-Corn, requires that a store or restaurant that allows guns on their property, post a prominent sign so stating, or face a civil penalty. This makes no sense, except as a form of intimidation for the stores and restaurants, dragging them into a political issue. Should stores and restaurants also post a list of all clothes, cell phones, necklaces, wrist watches, purses, wallets, and shoes that customers are allowed to possess, too?


This GOOD gun-bill PASSED out of subcommittee:

HB 2077, Delegate Wilt, removes the restriction on the right to keep and bear arms from emergency shelters.


Batting 1000 so far today. This afternoon will see 23 (!) more gun bills heard in MPPS Subcommittee #1.

Here are the bills:

HB 1432, Delegate Ware, makes switchblade knives legal again.

HB 1458, Delegate Lingamfelter, reduces the cost of a concealed handgun permit

HB 1989, Delegate Webert, provides relief from civil or criminal defense costs for someone found to have committed justifiable or excusable homicide.

HB 2265, Delegate Cline, allows persons who legally own a handgun to carry it concealed without a permit. The permitting system is kept and there are places where only a permittee can carry.

HB 2369, Delegate Pogge, removes the requirement that a person provide PROOF of a change of address when getting a replacement concealed handgun permit.

HB 2414, Delegate Ware, provides limited immunity to someone involved in a threatened, or actual, justified use of force or deadly force while reporting the event in good faith to seek emergency medical help or help from police.

THE DANGER TO CHP HOLDERS

There have been some real problems with Virginia CHP holders being stopped in Maryland and the Virginia State Police telling Maryland law enforcement that the driver has a Virginia CHP.

There is a bill in the General Assembly that will put an end to that issue, BUT THE SITUATION HAS JUST GOTTEN EVEN MORE URGENT.

Two days ago the Fourth Circuit Court of Appeals, whose rulings affect Virginia, West Virginia, Maryland, North Carolina, and South Carolina, said that during a stop an officer can frisk ANYONE AT WILL if he believes THEY HAVE A GUN, whether possessed LEGALLY OR ILLEGALLY - including being possessed by those who have a CHP!

So now, if you are stopped in Maryland, West Virginia, North Carolina, or South Carolina, and the officer finds out you have a CHP, he can frisk you without the need to have either reasonable, articulable suspicion or probable cause that you are armed AND dangerous.

This was a horrendous decision.


THE SOLUTION

Senator Stuart's SB 1023 is the solution. SB 1023 prohibits the Virginia State Police from sharing a person's CHP status with any state that does not honor a Virginia CHP. That makes perfect sense. If a state considers our CHPs to be nothing more than toilet paper, why even bother telling that state that you have such a "worthless" permit?

The good news is that HB 1023 cleared the Senate Courts of Justice today and is headed to the Senate Floor and then to the House.

Our critical challenge is that we need to get as many legislators of both parties on board to be in a position to override a possible veto by the Governor.

WE NEED **ALL** OF YOU TO SEND THE MESSAGE BELOW TO YOUR SENATOR TO 1) DRUM UP SUPPORT AND 2) TO EDUCATE THE SENATORS ON THE NEW FOURTH CIRCUIT RULING.

Delegate Lee Ware has introduced an important bill that gives a person limited immunity from prosecution when they call 9-1-1 for the purpose of getting help after using, or attempting to use, justifiable force or justifiable deadly force to protect themselves. This prevents something that you might say, perhaps in an extremely stressed emotional state, that could be used against you in a court of law.

So far 2,374 of you have contacted your Senator in support of SB 1023. That's not bad, but there are well over TEN TIMES that many of you receiving this Action Item!

Those of you with Senators who usually vote wrong on gun bills, WE NEED YOU ESPECIALLY to contact your Senator. The trouble is that everyone with such a Senator automatically assumes there is no point in contacting them and then NO ONE DOES! So the Senator assumes that there is little or no support in their district for gun rights.

That group-think and defeatism is hurting our cause. Some of those Senators can, and will, vote with us occasionally if they hear from enough gun owners in their district.

If you didn't do so last week, WE NEED **ALL** OF YOU TO SEND THE MESSAGE BELOW TO YOUR SENATOR TO 1) DRUM UP SUPPORT AND 2) TO EDUCATE THE SENATORS ON THE NEW FOURTH CIRCUIT RULING.

As a reminder this is the critical importance of SB 1023:

THE DANGER TO CHP HOLDERS

There have been some real problems with Virginia CHP holders being
stopped in Maryland and the Virginia State Police telling Maryland law
enforcement that the driver has a Virginia CHP.

There is a bill in the General Assembly that will put an end to that
issue, BUT THE SITUATION HAS JUST GOTTEN EVEN MORE URGENT.

Two days ago the Fourth Circuit Court of Appeals, whose rulings affect
Virginia, West Virginia, Maryland, North Carolina, and South Carolina,
said that during a stop an officer can frisk ANYONE AT WILL if he
believes THEY HAVE A GUN, whether possessed LEGALLY OR ILLEGALLY -
including being possessed by those who have a CHP!

So now, if you are stopped in Maryland, West Virginia, North Carolina,
or South Carolina, and the officer finds out you have a CHP, he can
frisk you without the need to have either reasonable, articulable
suspicion or probable cause that you are armed AND dangerous.

This was a horrendous decision, but we CAN FIGHT BACK!


THE SOLUTION

Senator Stuart's SB 1023 is the solution. SB 1023 prohibits the
Virginia State Police from sharing a person's CHP status with any
state that does not honor a Virginia CHP. That makes perfect sense.
If a state considers our CHPs to be nothing more than toilet paper,
why even bother telling that state that you have such a "worthless"
permit?

Lobby Day continues to pay off. All the gun-control bills are now dead for this year.

The following three pro-rights bills have passed both the House and Senate and are headed to the Governor's desk for his signature or veto:

HB1432, Delegate Lee Ware, legalizes switchblades and allows for concealed carry of them in certain cases.

HB 1582, Delegate Jeffrey Campbell, allows active duty or honorably discharged military members who are over 18 and under 21 years old to apply for a CHP. This would also fix the issue with Georgia not honoring our CHPs.

HB 1849, Delegate Gilbert, allows Circuit Court Clerks to laminate or create plastic CHPs.

There are another 15 pro-rights bills still working through the system in both houses.

We suffered one loss: SB 1441, Senator Glen Sturtevant, would have allowed gun owners to vote absentee if their poling place bans guns. This bill was put in for VCDL and we thank the Senator for doing so. We will look at other ways to skin that cat next year.

1. More gun bills to be heading to Governor's desk!

While all gun-control bills area dead for the year, the gun-rights bills continue to progress. New bills that have passed both houses and are headed to the Governor's desk:

HB1466, Fowler, Circuit Court Clerks can send email reminders when a CHP is going to expire within at least 90 days

HB 2325, Farris, requires a photo ID be provided when apply for, or renewing, a CHP, but the CHP application no longer needs to be notarized

HB 2369, Pogge, proof of address is no longer required when changing the address on a CHP

GOOD NEWS: Your emails on Delegate Wilt's HB 2077, which keeps us from being disarmed when a certain emergency shelters, helped get it passed out of committee by an 8 to 7 vote yesterday, but with much opposition. (Much thanks to Senators Ruff, Vogel, Black, Reeves, DeSteph, Suetterlein, Dunnavant, Sturtevant!)

HB 2077 STILL HAS TO SURVIVE A SENATE FLOOR VOTE IN A FEW DAYS.

* HB 1853, Delegate Gilbert, similar to SB 1300, Senator Vogel, makes firearms safety training free to victims of domestic abuse, sexual abuse, stalking, etc.

* HB 2429, Delegate O'Quinn, provides a mechanism to restore gun-rights for a person who had their gun rights removed for a mental health commitment, but now lives out of state

* SB 1315, Senator Carrico, allows foster parents to carry a firearm on their person, otherwise it is to be locked in a closet or cabinet, with the key out of reach of the children

* SB 1347, Senator Reeves, makes switchblades legal

* SB 1362, Senator Black, allows active duty members of the Virginia National Guard, Armed Forces of the United States, and Armed Forces Reserves of the United States to carry concealed without a permit and wherever they go in Virginia, including schools, courthouses, etc.

* SB 1533, Senator Obenshain, allows non-violent felons to possess, transport, and carry either an antique firearm or a back powder firearm for sporting, recreational, or cultural purposes

* HB 1392, Delegate Lingamfelter, authorizes a school security officer to carry a firearm on school property. Such an officer is a retired police officer and the local school board has given him authority to carry a firearm.

* SB 865, Senator Stuart, allows family members to transfer various knives to minor family members for the purpose of engaging in a sporting event or activity

Yesterday I had everyone contact their legislators to tell them to oppose Governor McAuliffe's attempt to hijack SB 1023 and to pass it as enrolled. DETAILS ON THE OTHER VETOED GUN BILLS

The Governor has actually been bragging about having the most vetoes of any governor, with none overridden. He's admitting that he could care less about the will of the People. That's really sad.

Here are the bills that are in jeopardy:

* HB 1582 (Campbell) and SB 1362 (Black) - allows active duty military or honorably discharged military under 21, but over 18, to apply to get a CHP

* HB 1852 (Gilbert) and SB 1299 (Vogel) - turns a protective order into a CHP instantly

* HB 1853 (Gilbert) and SB 1300 (Vogel) - provides free firearms training for victims of domestic violence (I guess the Governor doesn't like people to get firearms training)

* HB 2077 (Wilt) - allows citizens to carry in emergency shelters for self-defense

* SB 1315 (Carrico) - allows a foster parent to have a loaded handgun on their person while at home - hijacked to make current law more onerous

* HB 1432 (Ware) and SB 1347 (Reeves) - makes switchblades legal

* SB 865 (Stuart) - allows family members to transfer various knives to minor family members while engaging in sporting events or activities

If you haven't sent messages to your legislators to save those bills yet, the time to procrastinate is over. If they don't get out today when the legislators have time to read them, then there is no point.

The veto session concluded late last night. Two pro-rights bills survived and are now headed back to the Governor's desk for a final action.

The bill we have fought for the hardest at the end of the session is one of the two that has survived so far - SB 1023.

Here are the gun bills and their status:


BILLS HEADED BACK TO GOVERNOR'S DESK

SB 1023, Stuart, prevents the Virginia State Police from sharing CHP info with states that don't honor our CHPs. Lt. Gov. Northam ruled that the Governor's change to convert the bill into a One Handgun a Month bill was constitutional. The Senate disagreed and took a vote, which overrode the Lt. Governorl by a margin of 21-19, ruling the Governor's substitute bill as unconstitutional.

SB 1315, Carrico, foster parents can carry at home. The Governor's amendment which destroyed the bill was rejected with a bi-partisan vote - 24-16


BILLS SIGNED INTO LAW (effective on July 1)

HB 1466, Fowler, Circuit Courts Clerks to send out email reminders of expiring CHPs at least 90 days prior to expiration

HB 1849, Gilbert, allows Circuit Court Clerks to provide laminated or plastic CHPs

HB 2325, Fariss, requires a copy of photo ID when applying for a CHP, but eliminates the need for having the application notarized

BILLS THAT ARE NOW DEAD (To override a veto, there needs to be 67 votes in the House and 27 in the Senate. Some fell short by only one or two votes.)

HB 1432, Ware, switchblades legalized: no vote attempted

HB 1582, Campbell, military 18 and older can apply for a CHP: 66-32

HB 1852, Gilbert, protective orders become CHPs: 65-34 (Gilbert fought hard for his bill on the House Floor. Gilbert called out the blatant hypocrisy of those who were voting against this bill, but who were wearing ribbons in solidarity with crime victims.)

HB 1853, Gilbert, free training for domestic violence victims: 65-34 (Gilbert fought hard for his bill on the House Floor)

HB 2077, Wilt, emergency shelter carry: no vote attempted

SB 1299, Vogel, protective orders become CHPs: 22-18 (Vogel fought hard for her bill on the Senate Floor)

SB 1300, Vogel, free training for domestic violence victims: 22-18 (Vogel fought hard for her bill on the Senate Floor)

SB 1347, Reeves, switchblades legalized: 21-19

SB 1362, Black, military 18 and older can apply for a CHP: 21-19

SB 865, Stuart, allows family members to transfer various knives to minor family members: 21-19
